Welcome to Kirin Property Management. These Terms of Service ("Terms") govern your access to and use of our website, services, and any related applications (collectively, the "Services"). By creating an account, accessing our website, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Kirin Property Management.
2. Services Provided
Kirin Property Management provides comprehensive property management services, including but not limited to:
- Tenant screening and placement
- Rent collection and financial reporting
- Property maintenance coordination
- Lease administration and compliance
- Owner and tenant communication
- 24/7 emergency support
The specific services provided to you will be outlined in your individual service agreement with Kirin Property Management.
3. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.
4. Account Registration and Security
To access certain features of our Services, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and notify us immediately of any unauthorized use
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate your account if we suspect any unauthorized or fraudulent activity.
5. User Responsibilities
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Use our Services to transmit harmful, offensive, or illegal content

6. Payment Terms
Property owners and tenants agree to pay all fees and charges associated with our Services as outlined in their respective agreements. Fees may include management fees, maintenance costs, and other charges as applicable.
- All payments are due on the dates specified in your service agreement
- Late payments may be subject to interest charges or penalties
- We reserve the right to suspend services for non-payment
- You are responsible for all taxes associated with your use of our Services
7. Intellectual Property
All content on our website and within our Services, including text, graphics, logos, images, software, and other materials, is the property of Kirin Property Management or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
8. Third-Party Services
Our Services may integrate with or link to third-party services, such as payment processors, maintenance contractors, or software providers. We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is subject to their respective terms and conditions.
9. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that our Services will be uninterrupted, error-free, or secure. We are not liable for any delays, failures, or disruptions caused by factors beyond our reasonable control.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIRIN PROPERTY MANAGEMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Kirin Property Management, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your use of our Services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through our Services
12. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Discontinuation of our Services
Upon termination, your right to use our Services will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to intellectual property rights, disclaimers, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising out of or related to these Terms or our Services shall be resolved through binding arbitration in Halifax, Nova Scotia, in accordance with the Arbitration Act of Nova Scotia. The parties agree to waive any right to a jury trial or to participate in a class action.
14. Changes to These Terms
We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website with a new effective date. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms.
